Obviously, you don't know how the system work, well , Welcome to dealing with USCIS!
If I have never received a FP Notice from USCIS and then, they deny my EAD renewal because of this, that will be total absurd. I don't think any good immigration attorneys will let this go.

Hi,
My friend has this scenario and want expert advise from IV members.
- On L1 for 3 1/2 years and H1 for 2 years 3 months. About to complete 6
years in 3 months.
- Filed Labor (approved. PD Aug 2004 EB3), I140 (applied in May 2007) and
I485 (July fiasco)
- I140 still pending
Question:
1. Does L1 period is counted for H1 extention?
-- yes, time in both L1 and H1 counts together towards those 6 years. Its the time in L2/H4 that was decoupled a year or so ago.
2. Can he do H1 transfer using AC21 without I140 approval?
As 6 years are going to be expired?
yes, he will get a one year extension since his LC is atleast one yaer old.
3. What if the old employer revokes his I140 now? His GC process is invalid?
yes, the GC process ends right there. If he has transferred his H1 in the meantime and got an extension, the USCIS position so far has been that the extension remains valid, even though the underlying LC/I-140 are gone. The law itself is somewhat unclear, but till now the USCIS has not come back and revoked anyone's H1 extension (that I know of) because the underlying I\-140/LC are gone.
4. If we leave about GC, Can he do H1 transfer atleast?
yes he can, but he will need to start another labor ASAP from new employer to get any extension past this one year. He will also lose his old PD and will have a 2008/2009 PD.
He will also need a copy of his labor certificate to be able to file a transfer+extension.
At this stage the only thing between him and AC-21 freedom is that I-140 getting approved. So unless you know the I-140 is going to be denied, I would advise him to try his best to stay on with this employer until the I-140 is approved

My attorney tells me they don't give employees copies of labor applications.
Is this normal? Would I need it in future - if I switch jobs 180 days after 485 etc?
You don't need it If you stick to your employer till you get you GC.If you want to switch to other employer after 180 days of RD(Using AC21) , then you need to know the the position/title of your Labor (It's written on the Labor Certification) , because you have to accept a job with the same position/title with the new employer.Correct me if I am wrong.

If senior citizens have to travel frequently from India to the Bay area (California) what is the most preferred airlines?
Points of comparisons would be pricing (frequent flyer discounts), leg room, optimum layover, wheelchair facility, good in-flight attendance, food and so on...the experience with the emirates has been ok thus far.
emirates didn't provide the wheel chair at the airport although it was made available in india and sfo. also the leg from dubai to sfo is very long.
please share your experiences and provide your feedback.

IV physicians is a model for special interest work done within the IV framework. There was similar idea of I-140 PP group, which sadly didn't take off. Makes me wish I had chosen stethoscope instead of the keyboard :-).
Best of luck guys.

Interesting you brought this up. I am alumni of RPI and take great interest in current college activities.Read this in their this month's alumni magazine
"For several years President Shirley Ann Jackson has been warning of a looming gap in the science and engineering workforce, driver primarily by three factors. Those who responded to President John F Kennedy's historic call to action following launch of the Sputnik satellite and became the scientists and engineers whose work has fueled the US economy for a generation are on the verge of of retiring numbers.
As a nation of immigrants, the United States has relied on students, professors, and researchers who came from abroad to study and remain ,but in a "flattening" world offering expanding opportunities, their numbers are decreasing. In addition, not enough young people in this country are being excited and prepared to pursue careers in science and engineering.
These factors,in combination with the decreasing federal commitment to funding basic research, are what President Jackson describes as "quiet crisis"
"It is quiet because it takes decades to educate a scientist, mathematician, or an engineer,so the true impact unfolds only gradually, over time", says President Jackson.
"It is a crisis because the discoveries and innovations of our science and engineering workforce create the new opportunities and industries which keep our economy thriving, provide for our security, and mitigate the global scourges that breed suffereing and global instability."
Disclaimer: RPI has vested interest in fueling growth in undergraduate technical program. It is a very small private college, focussed exclusively on engineering and science programs. There are no arts or history major offered.

I second it :) NO SSN REQUIRED FOR PP. I filled out 000-00-0000 for my son. I believe there was a site or document I looked up and got this info (dont remember where I found it).
You dont need a PIO. If it is emergency or you dont have time, just get a multiple entry visa. For kids at that age it does not make any difference whether they enter on PIO or a visa. Chicago issues visa the same day.
BTW does Indian consulate do background check and issue 221(g) :D:D
PS: I live in IL as well and you dont need SSN for kids to get a PP :)

It is necessary to update USCIS on your divorce so that you can add your new wife to the GC process.

I think it is in the best interest of ImmigrationVoice and its members that offensive and derogatory messages be deleted/banned as they serve to harm the group as a whole.
However, the statement quoted below, if used out of context, will serve to be just as detrimental to ImmigrationVoice and its members because Free speech is the hallmark of this great country.
I would recommend that this statement be rephrased to say that while ImmigrationVoice champions the free speech, it is in the best interest of its members that the offensive posts be censored :
Immigration Voice neither promises nor practices "Free speech" and "First amendment rights"

Did Anyone got 2 year EAD when I-140 pending? There is some stupid assumption posted on some immigration website that USCIS is issuing 2 yr EAD to approved 140 petitions only..
Just want to confirm that.
Did anyone get 2 year EAD when they did not file labor?
If you think this question is stupid, and same with the above one too.

yeah the two shows 'Daily Show with Jon Stewart' and 'Colbert Report' run back to back. I have not seen any media personality that influential in shaping public opinion. They are mostly honest and ruthlessly blunt about issues.
IV members, please post your comments on his message board. If there are a substantial number of posts, only then we can hope for him to ever talk about our issue on his show.

Great ruling. The analysis is totally applicable to AOS. Moreover, the government admitted that it was wrong in recent memo.
"In the context of removal proceedings, ICE has determined that FBI fingerprint checks and Interagency Border Inspection Services (IBIS) checks are the required checks for purposes of the applicable regulations."
Wait a minute, isn't immigration judge able to grant AOS in removal proceedings? It means that the DHS acknowledges that it wrongfully interpreted regulations for all these years and that name check is not required by law (at least for AOS) as we were saying all along!
I love also this part: "in the unlikely event that FBI name checks reveal actionable information".
As judge Baylson pointed out, "name check" is nowhere to found in laws and regs.
Good point about the recent memo -- happily there are multiple pdfs of it floating around so they can't make that language disappear -- and and immigration judge granting AOS. Those two points should do.
About "name check" nowhere found in laws -- i.e no language in some obscure subsection -- I just want to make sure that the interpretation is ironclad for AOS, we know it is for naturalization.
Yep, I *love* the "unlikely event" part.

Di you submit all F1, H1, EAD documents to the USCIS with your original I0485 submission? Did you send any W2 forms?
Didn't submit anything related to F1 (Only grad certificate). I did submit paystubs + W2's...
Don't know what triggered USCIS for these RFEs..

No offense, my friend. I think you are in the wrong forum.
Anyhow, to give answer your question, in Houston, it took about 6 weeks. You can go there in person, get an appointment and you could cut down your processing time in half.
All this is based on the fact that it is a straightforward case.
